Nusyuz of Husband and Wife in The Perspektif of Legal Philosophy

This article examines the concept of nusyuz committed by husbands and wives from the perspective of Islamic legal philosophy. Thus far, nusyuz has more frequently been understood as a wife’s disobedience toward her husband, whereas the Qur’an also indicates the possibility of nusyuz being committed by a husband. This study aims to analyze the conception of a wife’s nusyuz, the conception of a husband’s nusyuz, and both concepts within the perspective of legal philosophy. This research employs a library research method with normative juridical and philosophical approaches. The data were obtained from the Qur’an, hadith, tafsir works, fiqh literature, statutory regulations, the Compilation of Islamic Law, and relevant scholarly works, and were then analyzed descriptively and analytically. The findings indicate that a wife’s nusyuz is understood as a form of non-compliance with household obligations, such as leaving the house without the husband’s permission, refusing certain obligations without a legally justified reason, and failing to preserve personal dignity. Meanwhile, a husband’s nusyuz may take the form of neglecting obligations, failing to provide maintenance, behaving harshly, harming the wife, or failing to treat the wife properly. From the perspective of legal philosophy, nusyuz should not be understood in a discriminatory manner; rather, it must be situated within the framework of justice, maslahah, the balance of rights and obligations, and the objective of marriage to establish a family characterized by sakinah, mawaddah, and rahmah.
